WILL DATED 1838.
This is the last Will and Testament of me Phineas William Palmer of Bishopswearmouth in the county of Durham Ship owner. I direct that all my just debts and funeral and Testamentary expences shall be paid out of my personal estateand effects except my household goods and furniture plate linnen china reading books wearing apparel and pictures which are hereby bequeathed to my wife absolutely. I give and bequeath all my household goods and furniture plate linen china wearing apparel pictures and reading books unto my wife Isabella Palmer for her own use and benefit absolutely for ever. I give and Devise unto Mark Street Palmer of Lower Halliford in the county of Middlesex Gentleman my wife Isabella Palmer and William Snowball the younger of Bishopswearmouth aforesaid Gentleman, all my share and Interest in a freehold estate in Shirbeck in the County of Lincoln and all other real estate which I may be possessed of or of which I may have power to dispose of at the time of my decease to hold the same unto and to the use of the said Mark Street Palmer Isabella Palmer and William Snowball their heirs and assigns for ever In trust for my wife Isabella Palmer and her assigns during her life for her and their sole benefit and after the decease of my said wife in trust for all and every or such one or more of my children as shall live to attain the age of twenty one years and their respective heirs and assigns in equal shares as servants in common. I give and bequeath unto the said Mark Street Palmer Isabella Palmer and William Snowball all my ships and vessels monies, securities for money debts and all other my personal estate and effects to hold the same ships and vessels monies, securities for money debts and all other my personal estate and effects unto and to the use of the said Mark Street Palmer Isabella Palmer and William Snowball the younger their executors administrators and assigns to according to the several natures and tenures thereof respectively upon the trusts following (that is to say)
Upon Trust that they said Mark Street Palmer Isabella Palmer and William Snowballor the survivors or survivor of them or the executorsor administrators of such survivors do and shall pay the Interest Dividends profits produce and gains thereof to my said wifeIsabella Palmer or permit her to receive the same during her life for her sole and separate use and benefit independently of any husband with whom she may happen to intermarry and without being in anywise subject or liable to his control debts interference or engagements And I direct that the receipts in writing of my said wife or of her appointees shall notwithstanding her covertures be sufficient discharges for the same Interest Dividends profits produce and gains and after the decease of my said wife I direct and declare that the said said Mark Street Palmer and William Snowball or the of them, his executors or administrators shall forthwith sell and dispose of my said ships and effects and such part of my Personal Estate as shall not consist of money or securities for money either by one or more public sale or sales or private contract or contracts unto any person or persons for such price or prices for ready money or otherwise as can be reasonably had or gotten of the same and shall collect receive and get in such part of my personal estate as shall consist of money or securities for moneys or debts due to me .And I declare that the said said Mark Street Palmer and William Snowball the survivors of them or the executors or administrators of such survivors shall stand possessed of the monies which shall be produced by the said sales and shall be collected and gotton mi as aforesaid and the rents interests dividends produce and profits uutie such salein trust for all and every of my child , and children and their respective executors Administrators, and assigns in equal shares as tesioucttins common to be paid to them respectively at their respective ages of twenty one years Provided always and I hereby further direct that if any of my said children shall die in my lifetime leaving Issue living at his, her or their decease or shall die after my decease under the age of twenty one years and leaving issue living at his, her or their decease as aforesaid the share or shares to which the Clued forltie time being dying as last aforesaid would have been entitled had he or she survived me and attained the age of twenty one years shall be in trust for such his or her issue in the same manner and shares as such Issue would have taken the same if the child in dying had attained the age of twenty one years and survived me and died intestate and unmarried. Provided always and I hereby declare that as to my share and Interest in the said Freehold Estate in Shirbeck aforsais directed by the will of my Father George Palmer to be sold and to such parts of my personal estate as shall at my decease consist of money or debts due to me or monies owing or securities it shall and may be lawful for the said Mark Street Palmer and William Snowball or the survivor of them or the executors Administrators or assignees of such survivor to
